1. What Atalaia is
Atalaia turns a spare Android phone into a security camera with end-to-end encrypted live streaming and (for premium) encrypted cloud backup. Footage stays on your devices and in encrypted blobs you control. We never see, store, or process your video.
2. Your account
You generate an account ID on your device and pick a password. We never see the password in clear text.
You are responsible for:
- Keeping your password secret: if you lose it, we cannot recover it. Your account is cryptographically locked to your password.
- Protecting your account ID: anyone with your account ID and password can sign in. Treat both as secrets.
- All activity from your account: we assume all activity is authorized by you.
We do not allow shared accounts. One person, one account.
3. Acceptable use
You may monitor:
- Your own property (home, garage, vehicle, etc.)
- Places where you have explicit permission to install a camera
You may NOT use Atalaia to:
- Record people in places where they have a reasonable expectation of privacy (bathrooms, bedrooms of others, changing rooms)
- Conduct surveillance of others without consent, where consent is required by local law
- Harass, stalk, or intimidate anyone
- Capture or stream copyrighted material you don't own the rights to
- Engage in any activity illegal in your jurisdiction
Important: Surveillance laws vary by country and region. You are responsible for knowing and following the laws that apply to you. If in doubt, consult a lawyer before deploying a camera.
Violation of this section is grounds for immediate account termination without refund.

We may add, remove, or change features at any time. We will not retroactively remove features already paid for during your current billing period.
5. Billing
Premium is billed in Bitcoin (BTC) on-chain through a self-hosted BTCPay Server. We do not custody your funds.

| Refunds: failed payment | If you paid for an invoice that fails to settle (network congestion, expired window), email us with the invoice ID and your refund address. We pay the on-chain fee. |
| Refunds: used premium | No refund for premium already used. |
| Refunds: terms violation | No refund for accounts terminated for terms violations. |

6. Service availability
Atalaia is provided "as is". We aim to keep the service up, but:
- No guaranteed uptime: no SLA.
- Outages may happen: maintenance, bugs, hardware failure, or events outside our control.
- Live streams are peer-to-peer: they depend on your local network, not just on us.
For a service this critical, always have an independent backup: a second camera, an alarm, a doorbell.
7. Limitation of liability
Atalaia is a tool. We are not a security company. We are not responsible for:
- Theft, damage, injury, or loss that occurs while using the service
- Missed alerts (delayed delivery, push notification failure, your phone being offline)
- Loss of footage (cloud provider, phone storage, password loss)
- Decisions you make based on what you see, or don't see, in the stream
To the maximum extent permitted by law, our total liability for any claim is limited to the amount you paid us in the 12 months preceding the claim, or €100, whichever is greater.
Nothing here limits liability for gross negligence, willful misconduct, or anything that cannot be limited under applicable law.
8. Termination
You may terminate
Anytime, by deleting your account in the app. Data is wiped per the Privacy Policy.
We may terminate your account if you:
- Violate the acceptable use rules
- Abuse our infrastructure (denial of service, mass account creation)
- Use the service for illegal activity
In case of termination by us, you forfeit unused premium time. No refunds for terms violations.
9. Changes to these terms
Material changes will be announced in the app and on the website at least 30 days before taking effect. Continued use after that constitutes acceptance.
10. Governing law
These terms are governed by the laws of Spain, without regard to conflict-of-law principles. The courts of Spain have exclusive jurisdiction, except where mandatory consumer protection laws in your country of residence provide otherwise (in which case those laws apply).
